[Geoserver-devel] ECW license changed?

Hi,
I was looking at the ECW SDK download page:
http://www.erdas.com/Products/ERDASProductInformation/tabid/84/currentid/1142/default.aspx

For version 3.3 it states:
- No more restrictions on the distribution of 'Server Software' under the GPL-style Public Use License Agreement

Hum, it would seem it is legal to redistribute a GeoServer with
embedded ECW reading abilities now provided we use that SDK (am I
missing something?).

Wondering what imageio-ext is using.

I have seend that as well, however I have also read this blog post
(http://www.massimozotti.it/2009/07/ecw-e-software-di-terze-parti.html)
from the italian redistributor which seems to contradict the one you
are linking.
Do you have any idea about we could get a definitve answer?

That page says one has to get a license no matter what, there is not mention of server software under the GPL license.

Reading the EULA inside the actual downloadable SDK sort of clarifies
things. At least, the EULA is closer to the blog post intent.

There are "non-commercial" uses of the SDK which are royalty free. But
the definition of non-commercial is very restricted. Basically only
non-profits and educational purposes count. Government use, company
use, etc, are all commercial.

Open source is considered "non-commercial", but only insofar as the
actual users of the packaged open source are themselves
non-commercial. So while there is an apparent exclusion for open
source, for practical purposes there is not one. You can include ECW
in your open source project, as long as it is not used for anything
except non-profits or teaching.

I've attached the EULA (hopefully not in violation of the EULA :slight_smile: for
your interest/information.
