Should the start.jar not be inside the "geoserver-bin.zip\geoserver\bin", it is currently in the "geoserver-bin.zip\geoserver". If it is I will move it.

It is left in the root because this they way it is if you download jetty and try to run geoseserver out of the box. So someone could point use their own installation of jetty if they choose just by setting GEOSERVER_HOME.
We just need to update the windows batch script correctly. I have tried but cant test it :).

We moved it out so that the starup.sh script will work with jetty already installed on someones machine (which has no bin directory) instead of forcing people to use our built in jetty support.
