The file is not there at all. My directory contains following after failed start:

All files are owned by tomcat and tomcat has also modification right for files and directories.

Just shooting in the dark:

Is it possible that this is the problem? Tomcat5 is not the newest tomcat. I am using Tomcat6 and there is everything working fine. Unpacking the war-file shows me that there isnt a config.xml in the war but after starting the tomcat there is one (and many more files). Perhaps this config is produced dynamically and the old tomcat-version is not working fine with geoserver?
Try using tomcat6 if the problem is still there.
And: What Java are you using? Oracle JDK6?
