I've tried this on build 1.3rc1 and it doesn't work.
1.3rc1 doesnt exist. Have you downloaded and tried 1.3.0-beta4?
is your geometry called "the_geom"?

Yeah, but it may have never been fully tested. It was fixed in
geotools, it may not have made it all the way into GeoServer. It was a
weird little problem, so we should test more.
