What version are you migrating from and to? Moving from GeoServer 1.4 to 1.5 raster support was added and additions were made to catalog.xml. However the format remains backwards compatable.

Which states that an sld file may need to be added to your data directory. However even if it is absent it should not result in a fatal error.
Is it really safe to migrate to a new version of geoserver while using the same data directory?
It should be. A later version of GeoServer should be able to read in an earlier version of the xml configuration files.
Will the new version check and update the files within it?
When you then resave the configuration the files will be written in the new format.
