That's definitely correct for general policy, but the code that uses a null geometry against things other than BBOX is kind of questionable, since I don't really know of any one that's needed it.
Though thinking back to the implementation things may work in some datastores. I don't think we need to spend a lot of effort try to support more than BBOX though, but if we don't then we should give good error messages.
